1. Agreement to Terms

By providing your mobile phone number and opting in to receive SMS (text) messages from NessaBit Home Services LLC, operating as NovaKnox ("we," "us," or "our"), you agree to these SMS Terms and Conditions ("Terms") and our SMS Privacy Policy.

These Terms govern your use of our SMS messaging service and constitute a legally binding agreement between you and NessaBit Home Services LLC.

2. SMS Program Description

Our SMS program allows you to receive:

• Service quotes and estimates
• Appointment reminders and confirmations
• Service updates and notifications
• Customer support messages
• Promotional offers and special deals (if you opt in)
• General service information

3. Consent and Opt-In

By checking the consent box and providing your phone number, you:

• Expressly consent to receive automated SMS messages
• Confirm that you are the account holder or authorized user
• Agree to receive messages at the number provided
• Acknowledge that you have read and accept these Terms

4. Message Frequency

You may receive up to approximately 10 messages per month. During active service periods or promotional events, frequency may increase.

Message and data rates may apply. Standard text messaging rates from your mobile carrier will apply to all SMS messages sent and received. We do not charge for SMS messages, but your carrier may charge you for:

• Incoming text messages
• Outgoing text messages (e.g., STOP, HELP)
• Data usage associated with text messages

Check with your mobile carrier for details about your messaging plan and rates.

6. Supported Carriers

Our SMS service is available on major U.S. carriers, including but not limited to:

• AT&T
• T-Mobile
• Verizon
• Sprint
• Boost Mobile
• Cricket Wireless
• Metro PCS
• U.S. Cellular
• Virgin Mobile

Carriers are not liable for delayed or undelivered messages.

7. How to Opt-Out (Unsubscribe)

You can stop receiving SMS messages at any time by:

• Text STOP: Reply with STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message

After you opt-out, you will receive one final confirmation message. You may receive messages for a short period while we process your request.

10. Message Delivery and Accuracy

• Uninterrupted service availability
• Error-free transmission

Message delivery may be delayed or blocked by:

• Your mobile carrier
• Network congestion

• Device or software limitations

Important: Do not rely solely on SMS messages for time-sensitive or critical communications. For urgent matters, contact us directly by phone.

By using our SMS service, you agree to:

• Not use the service to harass, abuse, or harm others

• Pay any applicable carrier charges

12. Prohibited Uses

• Transmit malicious code or viruses
• Violate any laws or regulations
• Infringe on intellectual property rights
• Impersonate others or misrepresent your identity
• Interfere with the service or network

14. Changes to Terms and Conditions

• Carrier charges or fees
• Unauthorized access to your device or account

Our total liability shall not exceed the amount paid by you for services in the three months preceding the claim.

You agree to indemnify, defend, and hold harmless NessaBit Home Services LLC, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including attorney's fees) arising from:

• Your use of the SMS service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws

18. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the SMS service shall be resolved through:

• Good faith negotiation between the parties
• Mediation in Knox County, Tennessee (if negotiation fails)
• Binding arbitration in Knox County, Tennessee (if mediation fails)

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our SMS Privacy Policy, constitute the entire agreement between you and NessaBit Home Services LLC regarding the SMS service and supersede any prior agreements.
